In this article, we would like to provide you an example of one of our
approved EB1A & EB2NIW cases.
The applicant has specialized in electromagnetic modeling and simulation
with applications to very large-scale integration (VLSI) circuits. He
currently works as a R&D researcher at one of the world’s leading companies
in analog and mixed-signal IC design and manufacturing, conducting cutting
edge research on the modeling of active devices, interconnects and packages
in VLSI circuits. He received M.S. in Microelectronics & Solid State
Electronics in his native country, and Ph.D. in Electrical & Computer
Engineering in the U.S.
At the time of filing his EB1A and EB2NIW petitions, the applicant had the
following documentary evidence on his research achievements: 1) 18 papers
published in top peer-reviewed journals, including IEEE Transactions on
Electron Devices, IEEE Electron Device Letters, IEEE Transactions on
Computer-Aided Design of Integrated Circuits and Systems (IEEE TCAD), Solid-
State Electronics, etc.; 2) 19 conference digests/presentations; 3) 100
citations from his first-authored papers and 103 citations from his co-
authored papers; 4) reviewer experience for 5 internationally-circulated
highly regarded technical journals and one international conference; and 5)
7 recommendation letters (5 independent expert opinion letters, 1 PhD
advisor opinion letter, and 1 former supervisor opinion letter).
For those applicants who file EB1A or both EB1A & EB2NIW, one of the
foremost EB1A criteria that they are required to meet with is to prove their
original scientific contributions of ‘major significance’ in the field.
Generally, CIS officers assess and determine whether the applicant’s
contributions are original and of major significance in the field, by
reviewing the applicant’s expert opinion letters and documentary evidence
of citation record, evidence of the applicant’s work being implemented/
utilized by others (e.g. patents), media reports relating to the applicant’
s work in the field, etc.
Particularly, testimonial opinion letters from experts are very important in
establishing that the applicant has made original scientific contributions
of major significance to his/her field of endeavor. That’s because, in
most cases, through the medium of expert opinion letters, the applicant can
provide as much detail as possible about his/her research contribution(s)
and explain, in detail, how research contributions are “original” (not
replicating the work of others) and how the contributions were of “major”
significance in his/her field of endeavor.
In this exemplified case, the applicant’s expert opinion letters and
documentation of citations were supporting evidence to prove this important
criterion. (The applicant had no achievements on patents, awards, media
reports, etc.) To satisfy this important criterion, we helped the
applicant prepare expert opinion letters that ‘specifically’ describe his
innovative and original research contributions of major significance in the
area of interconnect modeling in VLSI circuits, and ‘clearly’ show that
the citations to the applicant’s scholarly papers reflect his research
contributions of major significance in the field.
We filed the applicant’s EB2NIW petition first, followed by his EB1A
petition, and both petitions of his case were approved without Request for
