Many green card applicants worry that PPS processing may trigger RFE or NOID . So they chose to file EB1A in the CIS regular processing. Our experience is that a well-prepared EB1A in the regular processing can still be approved quite fast.
Recently, we helped one of our EB1A clients obtain an approval of his EB1A green card petition in 2 months and 9 days in the CIS regular processing. His I-140 EB1A application was filed on September 3, 2013 and approved on November 12, 2013.
An EB1A is an immigrant visa in the EB1 category that is reserved for foreign workers of extraordinary ability in the sciences, arts, education, business or athletics. The standard for EB1A is high, and reserved for those who have proven to be amongst the top few percent in their field. U.S. immigration laws have set out specific criteria to allow the foreign worker to prove “sustained national or international acclaim.” For EB1A, you do not need a job offer, but you should demonstrate that you are seeking to enter the US to work and substantially benefit the U.S.
In this case, our client received a Ph.D. degree in Materials Processing Engineering in his country, and is currently working as a postdoctoral research fellow at one of the prestigious universities in the U.S., working in the fields of structure engineering materials and metallic biomaterials. Through expert opinion letters and documentation of his research achievements, we have thoroughly argued and demonstrated that his past and current research studies have been critical for the high strength light alloys and bio-metals projects, funded by National Science Foundation (NSF) and Department of Energy (DOE), which have major significance to the development of super-strong light materials and novel biodegradable metallic materials.
In order to help this client establish the major significance of his research findings, we argued that the applicant’s research is of particular significance in the area of biomaterials and structure engineering materials. First, his research work has substantially contributed to the development of metallic biomaterials. The demanding for metallic biomaterials is increasing rapidly because the world population is getting increasingly older, and elderly people have a higher risk of hard tissue failure. However, most metallic biomaterials would stay permanently in the human body, which has observed the inflammation around the implants and even releasing toxic metallic ion. Some implants, which ideally provide a temporary support such as cardiovascular stents, bone pins, bone plates and bone needle, have to be removed from the human body by a subsequent surgical procedure after the tissue has healed completely. His research mainly focuses on the development of smart biodegradable materials for biomedical implants with controllable biodegradation rate, which has practical significance to improve American health care and the quality of life. In other words, his findings for biomaterials can bring the biomedical implants into a new age of smart implants with controllable service life, which completely avoids the second surgery and decreases the extra cost for patients.
Furthermore, we argued that the applicant’s research had been of substantial significance in the field of structure engineering materials. Super strong metals enhanced by large strain strengthening can be widely used in automotive engines, aircraft and rocket, shipbuilding, and transportation engineering. Actually, the application of light alloys in automotive and aircraft has been increasing year by year. Stronger metals make the automotive and aircraft safer than ever before and cost less gasoline. As the old materials are replaced by super-strong new materials enhanced by large strain strengthening, the whole nation will consume much less gasoline due to the weight loss, which significantly reduces the exhaust emissions and brings a huge benefit to the entire nation. As we all see the twenty first century as the energy century, the applicant’s pioneering research and contributions in this area certainly have a direct link and practical significance to the U.S. interest of an important energy and environment issues.
